1. Agreement
These Terms of Use govern your access to and use of michaelfieldenphotography.com and any services provided by Michael Fielden Photography ("we," "us," or "Michael Fielden"). By using this website, booking a session, or purchasing products, you agree to these terms.
2. Ownership of Photographs and Copyright
Every photograph, image, video, and piece of visual content created by Michael Fielden is the sole and exclusive property of Michael Fielden and is protected by United States copyright law (17 U.S.C. § 101 et seq.). Michael Fielden retains full copyright and all reproduction rights to every image at all times, including images delivered to clients.
No image may be copied, downloaded, screenshotted, reproduced, edited, cropped, filtered, printed, sold, licensed, published, or reused in any form, for any purpose, without the explicit prior written permission of Michael Fielden. This applies to personal, commercial, editorial, and social media use, and to both clients and the general public.
Purchasing a session, a digital file, or a print does not transfer copyright or grant reproduction rights. Any usage rights that are granted will be described in a separate written agreement or license and are limited to exactly what that document states.
Unauthorized use of any image is copyright infringement and may result in legal action, including claims for statutory damages and attorneys' fees. If you would like to use an image, contact michael@michaelfieldenphotography.com for written permission.
3. Model and Likeness
Where required, the appearance of any person in a photograph is governed by a separate model release. Clients and subjects grant no rights to the images themselves beyond any personal-use license expressly provided in writing.
4. Bookings, Quotes, and Deposits
Sessions are quoted individually. A booking is confirmed when the agreed deposit is received. Deposits reserve your date and time and, unless stated otherwise in writing, are non-refundable. The remaining balance is due as described in your quote.
5. Products, Prints, and Shipping
Prints and photo books are made to order. Because each item is produced individually, sales are final except where an item arrives damaged or defective, in which case we will repair or replace it. Delivery timelines are estimates.
6. Client Galleries
Private galleries are provided for your convenience to view and, where enabled, download images you have licensed. Gallery passwords are for your use only. The copyright and reuse terms in Section 2 apply in full to every image in a gallery.
7. Disclaimer and Limitation of Liability
This website and its content are provided "as is." To the fullest extent permitted by law, Michael Fielden Photography is not liable for any indirect or consequential damages arising from your use of the site or services.
